AnkAshram (together with any associated platforms, “AnkAshram”, “we”, or “us”) provides education and training services in data science and analytics through our website located at https://www.ankashram.com/ and associated tools, forms, or communication platforms (collectively, the “Site”, and the Site together with any courses, resources, consultations, or services provided by AnkAshram, the “Service”). By registering on the Site, submitting any form, or by visiting, browsing, or using the AnkAshram Service in any manner, you (“User” or “You”) agree to these Terms of Use (“Terms”), which form a legally binding agreement between you and AnkAshram. These Terms govern your access to and use of the Site and Services, and may not be altered by you without written permission from AnkAshram.

THESE TERMS SET FORTH LEGALLY BINDING TERMS AND CONDITIONS THAT GOVERN YOUR USE OF THE SERVICE. BY ACCESSING OR USING THE SITE OR SERVICE, YOU ARE ACCEPTING THESE TERMS ON YOUR OWN BEHALF OR ON BEHALF OF A COMPANY, INSTITUTION, OR OTHER LEGAL ENTITY. IF YOU ARE ENTERING INTO THESE TERMS ON BEHALF OF AN ORGANIZATION, YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS. IN SUCH CASES, THE TERMS “YOU” OR “USER” SHALL REFER TO THE ENTITY AND ITS AUTHORIZED USERS.

IF YOU ARE AN INDIVIDUAL USER, INSTITUTIONAL LEARNER, OR ORGANIZATIONAL REPRESENTATIVE, THESE TERMS APPLY TO YOU AS PER YOUR ENGAGEMENT WITH ANKASHRAM’S OFFERINGS.

YOU MAY NOT ACCESS OR USE THE SITE OR SERVICE IF YOU ARE UNDER 16 YEARS OF AGE, UNLESS YOU ARE PART OF A SUPERVISED LEARNING ENVIRONMENT WHERE YOUR PARENT, GUARDIAN, OR SCHOOL HAS PROVIDED CONSENT AND OVERSIGHT. IF YOU ARE UNDER 18 (OR THE AGE OF MAJORITY AS PER THE JURISDICTION YOU ACCESS THE SITE FROM), YOU MAY USE THE SITE ONLY WITH PARENTAL OR GUARDIAN CONSENT.

IF YOU DO NOT HAVE THE AUTHORITY TO ACT ON BEHALF OF YOUR ORGANIZATION, OR IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS STATED HERE, DO NOT ACCESS OR USE THE SITE OR SERVICE.

PLEASE NOTE: WHILE ANKASHRAM CURRENTLY OPERATES UNDER INDIAN LAW AND DOES NOT MANDATE ARBITRATION, ANY DISPUTES WHICH CANNOT BE RESOLVED INFORMALLY WILL BE SUBJECT TO THE JURISDICTION OF COMPETENT COURTS IN BHOPAL, MADHYA PRADESH, AS STATED IN SECTION 13 BELOW.

Account Creation and Responsibilities

1.1 Account Creation

To access certain features of the Service, you may be required to register for an account (“Account”) and provide certain personal details. By creating an Account, you represent and warrant that:

  • (a) all information you provide during registration is truthful, complete, and accurate, and
  • (b) you will keep this information updated and accurate at all times.

All information you provide is governed by our Privacy Policy, which is an integral part of these Terms. By using the Service, you consent to our use of your data as outlined in that policy.

If at any point you wish to discontinue using our services and delete your Account, you may request this by sending an email to admin@ankashram.com. Upon receiving your request, your Account and associated data will be permanently deleted within 14 business days.

AnkAshram reserves the right to suspend or terminate your Account at any time in accordance with Section 5 of these Terms, including but not limited to cases of misuse, violation of terms, or legal obligations.

AnkAshram Plans and Purchase Terms

2.1 Learning Plans

The features, duration, and pricing of access to AnkAshram’s services are determined by the specific learning program or course you register for using our registration form (“Plan”). Each Plan outlines the scope of sessions, materials, communication support, and follow-up resources offered. For more information about our offerings, please contact us directly or check the course descriptions shared via email, WhatsApp, or our website.

Note: AnkAshram does not require users to create login-based accounts. All interaction is initiated through a registration form, and communication is maintained via email, SMS, or WhatsApp.

2.2 Free Plan

If you register for any free learning opportunity or trial-based workshop offered by AnkAshram (“Free Plan”), you are granted a non-transferable, non-exclusive, revocable, and limited right to access the educational materials and communication for the specified period. AnkAshram reserves the right, at its sole discretion, to modify or withdraw your access to any Free Plan without prior notice and without liability.

2.3 Individual Learning Plan

When you register and pay for an individual learning program (“Individual Plan”), AnkAshram grants you a non-transferable, non-exclusive, revocable, and limited right to access our learning content and guidance for personal educational use during the specified program duration (“Individual Term”). This access will be governed by these Terms and any communication shared directly with you via registered contact details.

2.4 Institutional / Group Learning Plan

(a) Group Access License

If your organization, institution, or business partners with AnkAshram for a group learning experience (“Institutional Plan”), AnkAshram grants a non-transferable, non-exclusive, revocable, and limited right to designated participants to attend and access the service for the agreed-upon period (“Institutional Term”).

(b) Participants (“Seats”)

Each participating member (“Seat”) under the Institutional Plan must be registered individually via the form shared by AnkAshram. Seats are assigned to named individuals only and may not be shared, reused, or transferred among employees, students, or others. Unless separately agreed upon, Seats are not transferable to others during the course of the program.

(c) Seat Transfer Clause

You may, however, request to transfer up to 20% of unused Seats within the Institutional Term to new participants with prior written approval from AnkAshram. Such transfers must be requested via email at admin@ankashram.com and are subject to review.

(d) Additional Seats

Additional participants (“Seats”) may be added during the Institutional Term upon payment of applicable fees. Any new participants will receive the same services as those already enrolled, with pricing prorated for the remainder of the original term.

(e) Public Recognition

By registering under an Institutional Plan, you agree that AnkAshram may list your organization’s name and logo as a learning partner or participant in marketing and educational materials, unless otherwise requested in writing.

2.5 Classroom / Educator Programs

If you are a professor, teacher, or academic institution seeking structured learning for students (“Classroom Plan”), AnkAshram may offer limited access to resources for academic learning purposes. In such cases, you warrant that:

  • Each student is registered individually through the shared form.
  • You have obtained any required parental or institutional consent.
  • All Classroom Plan users are at least 13 years of age.

AnkAshram reserves the right to modify or withdraw Classroom access at its discretion.

2.6 Fees and Payment Terms

Access to any paid Plan is subject to full and timely payment of the applicable fee (“Program Fee”). Additional taxes or processing charges may apply depending on your payment method. Payment instructions will be shared via email or WhatsApp during registration.

Failure to make timely payment may result in suspension or cancellation of your access to the service. Unless explicitly stated, all Program Fees are non-refundable.

AnkAshram reserves the right to revise pricing at any time. However, changes will only apply to new enrollments or future renewals — not to existing, fully paid registrations.

2.7 Renewal and Continuation

AnkAshram does not offer automatic renewals. If you wish to enroll in another program or extend your learning, you will need to register through a new form or express interest through direct communication.

If you wish to discontinue your learning or communication with AnkAshram at any time, you may write to us at admin@ankashram.com. Your contact details and associated records will be permanently deleted within 14 business days of your request.

Usage of the Service

3.1 Restrictions

All learning content, communication, and services provided by AnkAshram are made available solely for personal or authorized institutional educational use. You agree to use the Service in accordance with these Terms and subject to the following restrictions:

  • (a) You shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Service or any part of the content shared by AnkAshram.
  • (b) You shall not modify, copy, create derivative works of, disassemble, reverse engineer, or repackage any part of the Service or content provided.
  • (c) You shall not use the Service or any content shared by AnkAshram to build, support, or promote a competing product, service, or training program.
  • (d) No content—including videos, PDFs, slides, exercises, or communication materials—may be copied, published, redistributed, or transmitted without express written permission from AnkAshram. All copyright, logo, and proprietary notices must be retained on any approved copies.

3.2 Usage Limits

AnkAshram reserves the right to monitor the usage and engagement levels of any registered learner or group participant. If we, at our sole discretion, determine that your behavior exceeds normal or reasonable usage (e.g., repeated redistribution of content, use of one registration by multiple individuals, or abuse of free/discounted programs), we reserve the right to terminate or restrict your access to future services.

In the case of Institutional Plans, if usage is observed to exceed the agreed number of participants or includes unauthorized access by non-registered individuals, we may suspend the service, revoke Seats, or charge additional access fees.

3.3 Modification of Services

AnkAshram reserves the right to add, remove, or modify any part of the Service at any time, without prior notice or liability. This includes changes to course content, delivery format, learning duration, or communication methods. Your continued use of the Service following any modifications constitutes your acceptance of such changes.

If you are dissatisfied with any aspect of the Service, your sole and exclusive remedy is to discontinue use.

Unless otherwise specified, all future enhancements or features will also be governed by these Terms.

3.4 Availability of Service

You understand and accept that delays or interruptions in accessing learning materials may occur due to internet bandwidth, platform updates, scheduled maintenance, or other factors outside AnkAshram’s control. We are not liable for any such disruptions and you agree not to hold AnkAshram responsible for temporary inaccessibility or slow performance of the Service.

3.5 Support and Maintenance

AnkAshram is a lightweight, human-led education platform. While all our classes are conducted via Zoom, we communicate with learners through email, SMS, or WhatsApp for updates, reminders, and guidance.

We strive to offer timely and helpful support during the course of your learning journey. However, we do not guarantee 24/7 technical support or formal platform maintenance services. Assistance is provided on a best-effort basis during our standard working hours.

Payment Terms

4.1 Payment

By enrolling in any paid program, course, or training workshop conducted by AnkAshram, you agree to pay the one-time fee or term-based fee communicated to you at the time of registration. Fees may vary depending on the nature of the course, duration, or value-added features.

Pricing may be subject to change based on geographic location, promotional offers, or currency exchange differences where applicable. The final fee amount and payment instructions will be clearly shared with you via email, SMS, or WhatsApp after registration.

Once you proceed with payment, it is understood that:

  • You agree to the terms of enrollment and participation.
  • Non-payment or delayed payment may result in cancellation or non-confirmation of your seat.

4.2 Billing Authorization

Depending on the course or plan selected, you may be asked to make the payment via:

  • UPI
  • Bank transfer
  • Payment gateway
  • Other methods as communicated by AnkAshram

By initiating the payment, you authorize AnkAshram or its payment partners to process your transaction. You agree to ensure the validity of the payment method and bear any additional bank or platform charges incurred during the transaction.

AnkAshram is not responsible for any penalties, insufficient balance fees, or failed transactions due to incorrect payment details or delays from your financial institution.

4.3 Third-Party Payment Processors

All payments are collected via secure third-party processors (e.g., Razorpay, Paytm, or direct bank interfaces). You agree to pay all applicable fees at the prices in effect at the time of enrollment, following the instructions shared by AnkAshram.

You further agree that AnkAshram or its payment partners may correct any pricing or invoicing errors, even after a transaction is initiated or completed, and notify you of such corrections if required.

4.4 Invoice-Based Payments (For Institutions or Bulk Enrollments)

If you represent an institution or organization enrolling in a group learning plan, AnkAshram may offer an invoice-based payment option.

In such cases:

  • An official invoice will be raised at the time of course confirmation or Seat allocation (“Start Date”).
  • The total fee mentioned in the invoice is payable within 15 days of the invoice date.
  • Payment must be made according to the bank details and instructions mentioned in the invoice.

Failure to make payment within the stipulated time may result in suspension of services for your participants.

Termination and Cancellation

5.1 Termination by AnkAshram

AnkAshram reserves the right to terminate or suspend your access to any ongoing or upcoming course or communication if:

  • You violate any part of these Terms or engage in conduct inconsistent with the spirit of the program.
  • You misuse any shared content, distribute proprietary materials without permission, or disrupt the learning environment.
  • We determine, at our sole discretion, that your participation is no longer viable for operational, legal, or educational reasons.

Such termination may occur without prior notice, and AnkAshram will not be liable for any losses or inconvenience caused by this termination.

5.2 Cancellation – Individual Learners

If you are an individual learner enrolled in a paid course or workshop and wish to cancel your participation:

  • You must write to admin@ankashram.com at least 7 days before the course start date to be eligible for consideration of deferral or substitution, where possible.
  • Course fees are non-refundable, including in cases of partial attendance or early withdrawal, unless otherwise explicitly stated.
  • If you cancel after the course has started, your access will remain active until the course ends, but no refund will be issued.

5.3 Cancellation – Institutional / Group Programs

(a) Termination for Cause

In the event of a breach of these Terms or the terms agreed in a separate institutional engagement, either AnkAshram or the organization may terminate the agreement. A written notice specifying the breach must be provided, and a 15-day window shall be given to resolve the issue. If the breach is not resolved, termination may proceed.

All program fees paid remain non-refundable, and any pending dues become immediately payable upon cancellation.

(b) Termination for Convenience

Organizations may choose to cancel an upcoming Institutional Plan for convenience by notifying AnkAshram at least 15 days in advance of the program start date. In such cases:

  • Paid amounts will not be refunded.
  • Access for enrolled participants will remain valid until the scheduled end date, if applicable.

5.4 Effect of Termination or Cancellation

Upon termination or cancellation:

  • Your right to access learning materials, attend Zoom sessions, or receive support from AnkAshram will end immediately.
  • Any communication or personalized follow-up related to the course will also cease.
  • AnkAshram may delete any associated records (such as form submissions, notes, or chat history) after a reasonable retention period.

AnkAshram shall not be held liable for any consequences arising from such termination. Certain provisions of these Terms—such as those related to payment obligations, intellectual property rights, disclaimers, and governing law—shall continue to remain in effect even after termination.

Intellectual Property

6.1 Ownership

Unless explicitly stated otherwise, all content, learning materials, presentations, designs, exercises, session recordings, insights, and communication shared as part of AnkAshram’s services ("Proprietary Materials") are the sole intellectual property of AnkAshram or its content collaborators. This includes—but is not limited to—class decks, course slides, notes, examples, graphics, tools, frameworks, and statistical summaries derived from participant activity.

While you may provide personal input or responses (“User Content”) during sessions or discussions, you acknowledge and agree that your participation does not transfer or assign any ownership rights to you in any of the Proprietary Materials.

AnkAshram may use aggregate data or anonymized learnings from user responses or feedback to improve content and learning design. Such usage will never personally identify you without your explicit consent.

Accessing AnkAshram’s learning services does not grant you permission to copy, distribute, modify, or store any Proprietary Materials beyond what is explicitly allowed, including:

  • downloadable material shared directly for educational purposes (such as exercise files or reading PDFs),
  • content temporarily stored by your browser for display,
  • content emailed to you for your individual learning use.

You may not reproduce, share, or republish any AnkAshram material on social media, in professional environments, or for commercial use without express written permission.

6.2 Rights and Warranties

AnkAshram represents and warrants that:

  • We own or have valid rights, permissions, and licenses to all Proprietary Materials used in our courses and offerings.
  • Our teaching content and delivery methods do not knowingly infringe upon or misuse the intellectual property rights of any third party.

This warranty does not apply in cases where third-party misuse arises from your combining AnkAshram content with external tools, apps, or user-generated materials that are not under AnkAshram’s control or recommendation. All rights not expressly granted in these Terms are reserved. This includes rights related to branding, content reproduction, training methodology, and the AnkAshram name and logo.

User Content

7.1 Definition and Responsibility

“User Content” refers to any information or material you voluntarily share with AnkAshram through registration forms, emails, WhatsApp messages, SMS, Zoom chats, feedback forms, or assignments—including but not limited to questions, messages, opinions, voice notes, documents, and verbal contributions during live sessions.

You are solely responsible for your User Content and the consequences of sharing it. This includes any personal information you provide and any disclosures you make about yourself or others. You agree that:

  • You will not submit any content that violates the rights of others or is harmful, misleading, or offensive.
  • Your User Content will not contain or represent confidential material belonging to others without proper consent.

AnkAshram does not take responsibility for monitoring or storing all User Content and reserves the right to delete or disregard content that is deemed inappropriate or irrelevant to the learning context.

7.2 Limited License

By submitting User Content to AnkAshram (e.g., feedback, suggestions, testimonials, assignments), you grant us a non-exclusive, royalty-free, irrevocable license to:

  • Use, reproduce, display, and share this content in anonymized or aggregate form for educational, analytical, and promotional purposes.
  • Edit or excerpt your content (without changing its intent) to showcase learner experiences or improve our teaching process.

We will not publicly disclose your name, identity, or personal details without your explicit consent.

7.3 Restrictions on User Content

You agree not to submit or share content that:

  • (a) Infringes on copyrights, trademarks, privacy, or intellectual property rights of others.
  • (b) Is offensive, unlawful, abusive, threatening, discriminatory, obscene, defamatory, misleading, or promotes harm.
  • (c) Contains sensitive personal data (see below), viruses, or spam.
  • (d) Attempts to collect personal data of other users without consent.
  • (e) Interferes with the delivery of classes or disrupts the experience of other learners.

Sensitive Information includes passwords, financial or payment data, health information, biometric identifiers, government-issued ID numbers, or anything covered under data protection laws (such as GDPR, HIPAA, or PCI-DSS). You agree not to transmit or store such information via AnkAshram’s communication or form systems.

AnkAshram is not liable for damages arising from accidental or deliberate sharing of such sensitive data.

7.4 Enforcement

While AnkAshram is not obligated to review or moderate every submission, we reserve the right to:

  • Review and remove any User Content that violates these Terms.
  • Discontinue communication or access for users who breach content restrictions.
  • Report unlawful or abusive behavior to relevant authorities if necessary.

7.5 Feedback and Suggestions

If you provide AnkAshram with feedback, suggestions, or testimonials related to our services, you agree that:

  • We may use your feedback to improve our courses, materials, or operations.
  • Such feedback is considered non-confidential and non-proprietary, unless agreed otherwise in writing.
  • You will not submit any ideas or proposals you wish to keep confidential unless you have an NDA with us.

Third-Party Links, Tools & Other Users

8.1 Third-Party Links, Tools & Ads

As part of your learning journey with AnkAshram, we may share or integrate with third-party platforms, including but not limited to:

  • Learning Management Systems (LMS)
  • Zoom for video conferencing
  • Razorpay or other payment gateways
  • File-sharing or collaboration tools (e.g., Google Drive, Miro, Notion)
  • External websites, videos, or articles for reference
  • Third-party ads or promotional partnerships (if applicable)

These third-party tools, platforms, websites, or advertisements (collectively, “Third-Party Links & Tools”) are not owned or controlled by AnkAshram, and we are not responsible for:

  • The content, availability, or accuracy of such external tools or links.
  • Any misuse of your data by such third-party platforms.
  • Transactions, purchases, or decisions made on third-party sites.

We provide access to such tools or content only as a convenience, and do not warrant, endorse, or assume responsibility for any product, service, or privacy policy of third parties. Your use of such third-party links is entirely at your own risk. You are encouraged to review their privacy policies and terms of use before engaging with them.

8.2 Other Users

While AnkAshram may host group sessions or batch interactions, you are solely responsible for your communication and interactions with fellow participants. Any content shared by other users (e.g., in a Zoom chat, WhatsApp group, or discussion forum) is their responsibility.

AnkAshram:

  • Does not moderate all interactions or user-shared content.
  • Cannot guarantee the accuracy, integrity, or usefulness of User Content provided by other participants.
  • Is not liable for any loss, offense, or conflict that may arise from your interaction with other users.

If a dispute arises between you and another learner, you agree that AnkAshram has no obligation to mediate or intervene. However, we reserve the right to remove or restrict users in the interest of maintaining a safe and respectful learning environment.

Indemnification

You agree to indemnify, defend, and hold harmless AnkAshram, its founders, facilitators, instructors, employees, and agents from and against any and all claims, liabilities, damages, losses, demands, costs, and expenses (including reasonable legal and attorney’s fees) that arise out of or relate to:

  • Your participation in or use of any part of AnkAshram’s services (e.g., courses, Zoom sessions, shared tools);
  • Your violation of these Terms of Use or any applicable laws;
  • Any content, feedback, files, or materials submitted by you that infringe, misappropriate, or otherwise violate the rights of any third party (including intellectual property, privacy, or moral rights);
  • Misuse of shared third-party tools, platforms, or payment channels provided for convenience by AnkAshram.

AnkAshram reserves the right—at your cost—to assume the exclusive defense and control of any matter subject to indemnification. In such a case, you agree to cooperate fully with our defense and may not settle any claim without our prior written consent.

We will make reasonable efforts to notify you in writing upon becoming aware of any such claim, demand, or legal proceeding for which indemnification may be required.

Data Privacy

AnkAshram is committed to protecting the privacy and personal information of its users in accordance with applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).

10.1 Personal Data Collection and Use

We collect limited personal data through registration forms, including but not limited to:

  • Name
  • Mobile number
  • Email address
  • Learning preferences or goals

This information is used solely to:

  • Communicate with you via email, SMS, or WhatsApp
  • Deliver learning content or session updates (including Zoom links)
  • Respond to your queries or feedback
  • Track engagement for internal analytics and content improvement

We do not sell, rent, or trade your data to any third party.

10.2 Data Storage and Access

Your information may be stored on secure third-party platforms (such as CRM systems or cloud storage) that are compliant with reasonable security standards. Access to this data is limited to authorized personnel at AnkAshram and is used only for legitimate educational purposes.

We take reasonable organizational and technical measures to safeguard your personal data against unauthorized access, disclosure, or loss.

10.3 User Rights

As a user, you have the right to:

  • Request access to the personal data we hold about you
  • Request correction or deletion of your information
  • Withdraw consent for communication at any time

To exercise any of these rights, simply email us at admin@ankashram.com. Data deletion requests will be fulfilled within 14 business days, unless legally restricted.

10.4 Third-Party Services and Tools

If we use third-party tools (e.g., payment gateways, Zoom, learning management platforms), your data may be processed according to their privacy policies. We recommend reviewing their policies directly, as AnkAshram is not responsible for how those services handle data once you interact with them.

Disclaimers

Except as expressly stated in these Terms, AnkAshram’s services are provided on an “as-is” and “as-available” basis. To the fullest extent permitted under applicable law, AnkAshram and its instructors, affiliates, suppliers, and facilitators disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, availability, or reliability of content
  • Freedom from errors, disruptions, or technical issues

We do not guarantee that:

  • The sessions or services will meet your specific expectations or outcomes;
  • The classes (held over Zoom or other third-party tools) will be available without interruption or free from technical issues;
  • Any shared resources, tools, or external links will be accurate, reliable, or virus-free;
  • You will achieve a particular skill level, job placement, or certification outcome through our courses.

All learning outcomes depend on your own effort, consistency, and understanding, and AnkAshram assumes no liability for results based on educational participation.

If applicable law in your jurisdiction (such as India’s Consumer Protection laws) does not permit the exclusion of certain warranties, some or all of the above disclaimers may not apply to you. In such cases, warranties will be limited to the shortest period permitted under law, not exceeding ninety (90) days from the date of first participation.

Limitation of Liability

12.1 Exclusion of Consequential and Related Damages

To the maximum extent permitted by applicable law, AnkAshram, its founders, educators, affiliates, and any associated service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

  • Loss of data, revenue, profits, goodwill, or anticipated savings
  • Costs of substitute services
  • Any interruptions in service delivery (including Zoom-based sessions, LMS downtime, or third-party tool failures)
  • Technical failures or user errors during participation in online sessions
  • Reliance on advice or recommendations given during sessions or communications

Even if we have been advised of the possibility of such damages, you agree that your use of the service is at your sole risk and discretion, and AnkAshram shall not be liable for any damage to your device, loss of access, or educational outcomes.

12.2 Monetary Cap on Liability

To the fullest extent permitted under law, AnkAshram’s total liability, whether in contract, tort (including negligence), or otherwise arising out of or in connection with your use of the services, shall not exceed the total amount paid by you to AnkAshram in the 12 months preceding the event giving rise to the claim. If no amount has been paid, our liability shall be limited to INR 1,000.

You acknowledge and agree that our third-party platform providers (e.g., payment gateways, LMS providers, communication tools) bear no liability whatsoever under these Terms.

12.3 Independent Allocation of Risk

Each provision of these Terms that limits liability, disclaims warranties, or excludes damages is intended to fairly allocate the risks between you and AnkAshram. This allocation forms an essential part of the basis of the agreement between the parties and reflects the pricing and educational structure offered.

These provisions are independent and severable, and will remain in effect even if any limited remedy fails in its essential purpose.

12.4 Jurisdictional Exceptions

Some jurisdictions may not permit the exclusion of implied warranties or the limitation of certain damages. In such cases, the limitations and exclusions outlined here will apply only to the extent allowed under applicable law, and our liability will be limited to the maximum extent permitted.

Dispute Resolution

13.1 Friendly Resolution First

At AnkAshram, we believe that most issues can be resolved through simple, honest communication. If you have a complaint, concern, or dispute related to our services, we strongly encourage you to first reach out to our support team via email to attempt a resolution in good faith.

13.2 Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. In case a dispute cannot be resolved informally within 30 days, both you and AnkAshram agree that such disputes will be subject to the exclusive jurisdiction of the competent courts of Bhopal, Madhya Pradesh.

13.3 Arbitration (If Mutually Agreed)

If both parties agree in writing, disputes may be resolved through arbitration under the Arbitration and Conciliation Act, 1996 (as amended from time to time). The arbitration will be conducted in English, and the venue shall be Bhopal. The decision of the sole arbitrator, mutually appointed by both parties, shall be final and binding.

13.4 No Class Actions

You agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

13.5 Injunctive Relief

You agree that AnkAshram may seek equitable or injunctive relief in any court of competent jurisdiction if you breach or threaten to breach any of these Terms, particularly those related to intellectual property, confidentiality, or misuse of services.

General

15.1 Changes to the Terms

These Terms may be updated or amended by AnkAshram from time to time. If we make material changes, we will notify you either:

  • By sending an email to the last email address you provided us (if applicable); and/or
  • By prominently posting a notice on our website or within the Service platform.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not agree to any updated Terms, you must stop using the Service. Changes will be effective:

  • Thirty (30) days after we post notice on the website or notify you via email, whichever is earlier, or
  • Immediately for new users registering after the updated Terms are posted.

15.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or relating to these Terms, the Service, or your relationship with AnkAshram shall be subject to the exclusive jurisdiction of the courts located in Bhopal, Madhya Pradesh, and you hereby consent to the personal jurisdiction of such courts.

15.3 Export Compliance and Anti-Corruption

You agree to comply with all applicable laws and regulations, including those related to import/export, anti-corruption, and anti-bribery. You represent and warrant that:

  • You are not listed on any government-sanctioned or denied-party list, including but not limited to those published by the Government of India or international agencies.
  • You will not export, re-export, or transfer any part of the Service or its technical content in violation of applicable laws.
  • You have not and will not offer or accept any illegal or improper payment, bribe, gift, or benefit in connection with your use of the Service.

15.4 Notice

All notices required under these Terms must be in writing and may be delivered as follows:

  • To you: via email to the email address specified in your account settings, or by displaying the notice prominently within the Service interface.
  • To us: via certified mail (return receipt requested), email, or other recognized commercial methods to the contact information listed in Section 15.9 or as otherwise updated on our official website.

Notices will be considered effectively delivered only if provided in accordance with this Section. Any notices not given as described here shall be deemed invalid and ineffective.

15.5 Entire Terms

These Terms constitute the entire and exclusive agreement between you and AnkAshram concerning your access and use of the Service, and they supersede any prior agreements (oral or written) between you and us with respect to the Service.

In the case of Business Plan subscribers or enterprise clients, where an executed agreement, such as a Master Service Agreement (MSA) or Order Form, conflicts directly with these Terms, the terms of the executed agreement shall prevail to the extent of the conflict.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision. Section headings are for reference only and shall not affect the meaning or interpretation of any section.

Words such as:

  • “including” shall mean “including, but not limited to”
  • “may” shall mean “has the right, but not the obligation to”

If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be interpreted to reflect the original intent as closely as possible in accordance with applicable law.

15.6 Independent Contractor

The relationship between you and AnkAshram is strictly that of independent contractors. Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship. Neither party has authority to bind or represent the other in any manner unless explicitly agreed in writing.

15.7 Assignment

You may not assign, delegate, transfer, or subcontract any of your rights or obligations under these Terms without the prior written consent of AnkAshram. Any such attempted assignment or delegation without consent shall be null and void.

AnkAshram reserves the right to freely assign or transfer its rights and obligations under these Terms, including in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms shall be binding upon and inure to the benefit of permitted assignees and successors.
